AG Corbett Announces Arrest of Beaver County Man in "Neglect of Care" Case
HARRISBURG - Attorney General Tom Corbett today announced that agents from the Attorney General's Medicaid Fraud Control Section and the Ambridge Police Department have arrested a Beaver County man on charges of criminally neglecting his elderly mother, causing her to suffer serious bodily harm.
Corbett identified the defendant as George W. Davies, 39, of 1015 Rice Avenue, Ambridge, Beaver County.
The charges state that Davies failed to provide proper care to his 72-year old mother, Evelyn Delai, who was hospitalized on January 1, 2005 for treatment of a variety of neglect-related injuries.
Corbett said doctors at Sewickley Valley Hospital reported that Delai was emaciated, dehydrated and caked with waste. She had numerous deep pressure sores, infected wounds and areas of dead tissue covering her body, which one doctor described as "horrific."
"Caretakers are required by law to make sure that the people they are caring for get the proper medical treatment, food and care that they need to remain health and safe," Corbett said. "Anything less is criminal, and will not be tolerated in Pennsylvania."
Corbett stated that doctors indicated that Delai's severe injuries and very poor health condition would have taken weeks to develop. At the time of her admission to the hospital, Delai weighed just 74 pounds and doctors estimated she only had a 20 percent chance of survival.
According to the criminal charges, Davies was the primary caretaker for his mother for the past eight years. That care was allegedly provided in exchange for Delai's monthly pension and social security benefits, which were used to pay the lease on Davies' residence.
Corbett explained that Pennsylvania's "Neglect of a Care-Dependent Person" statute makes it a criminal violation for a caretaker to intentionally, knowingly or recklessly cause bodily injury by failing to provide treatment, care, goods or services necessary to preserve the health, safety or welfare of a care-dependent person.
