Negligence and Personal Injury

Personal injury lawsuits may arise from any number of circumstances, but among the most common circumstances is negligence. Negligence is the failure to exercise what is considered reasonable action in a given situation. Negligent actions may occur in many walks of life, and several of those actions may cause you serious harm if you are in the wrong place at the wrong time.

If a negligent action was the cause of your injury, contact the Pennsylvania personal injury lawyers of Lowenthal & Abrams, P.C. at 610-667-7511.

When Is an Action Negligent?

In order to prove that the action that caused your injury was negligent, you will have to prove that it met the following criteria:

1.Someone owed you a duty of care

2.That person failed to uphold his or her duty to you

3.As a result of that person’s failure to uphold his or her duty, you suffered harm

4.Harm was a foreseeable consequence of that person’s action or inaction

If you cannot prove that the action met all four criteria, you may not be able to win your case. If you think you are the victim of negligence, hire an experienced Pennsylvania personal injury attorney to give you proper legal counsel before you file your lawsuit.
