Amadio v. Levin -
The Supreme Court of Pennsylvania reversed
the rulings of the Philadelphia County Court of Common
Pleas and the Pennsylvania Superior Court in finding
that the parents of a stillborn child who died as a result
of prenatal injuries could bring a lawsuit, in their
own right and on the stillborn child's behalf, against
the mother's obstetricians under the state's wrongful
death and survival statutes.
The court recognized a viable fetus in utero
as having a separate existence from the mother and
as thus able to sustain injuries independently of the
mother. Live birth would no longer be a limiting prerequisite
to parental action on behalf of the child's estate.
